The brand new city of Mableton, in Cobb Co., has only existed as an official city since November and only just elected its first mayor last month. But now its very existence has been thrown into question by a lawsuit filed by some of its own residents, who say language in the bill that created the city is “unconstitutional and fatally defective.” The language in question called for the creation of both Mableton and of a CID within the city, but state law says that separate governmental bodies can’t be created in the same piece of legislation. That means Cobb County Superior Court Judge Sonja Brown could, with one ruling, erase the city and its newly-elected mayor and city council.
