With stunning finality to one of the longest running court cases in Cobb County, Superior Court Judge Robert Flournoy dismissed the last and final charge brought against former Cobb EMC Chief Executive Officer Dwight Brown.
For over ten years Brown came under fire and ultimately lost his job based on charges that ranged from outright theft to RICO and racketeering charges. One by one the charges have been dropped or dismissed with the final charge being thrown out for lack of any evidence or validity.
In closing arguments Brown’s attorney, former Gov. Roy Barnes blasted the efforts of former Cobb District Attorney Pat Head. He called it “over-prosecution” and a “witch hunt that should have never happened in the first place.” Judge Flournoy agreed with Barnes and his legal team and tossed the final charge.
The prosecution has the right to appeal the judge’s ruling but most legal minds familiar with the facts of the case believe it to be over.
Since the investigation began, the Cobb EMC Board and the executive offices have seen an almost complete turnover. It would seem this long running saga has finally come to a close for both Brown and the Cobb EMC ratepayers.
