InsiderAdvantage is still sifting through the many bills that passed into law during the 2019 General Assembly, and we found two underreported but important ones in the lucrative area of local government contracting and bids.
H.B. 315 requires the disclosure, and the use of a written contract, between individuals who provide consulting services to local governments concerning specifications or requirements for local government contracting, bids, procurement or purchase orders. In the contract, the consultant must agree to avoid and disclose any conflicts of interest.
However, these disclosure requirements do not apply to state entities including the state Department of Economic Development Authority.
H.B. 322 increases from $10,000 to $100,000 the threshold requirement that local government bid or proposal opportunities be posted in the Georgia Procurement Registry, be posted at the office of the government entity and be placed on the government entity’s website.
Giving notice of the bid opportunities in the local legal organ newspaper is not required.
