The Georgia Supreme Court granted a new trial for Claud “Tex” McIver, the prominent Atlanta lawyer convicted of his wife Diane’s 2016 murder. It ruled that jurors should have been allowed to consider a misdemeanor involuntary manslaughter charge, not only a murder charge for the shooting. This would have let jurors decide whether McIver was criminally negligent, not only whether he intentionally killed his wife. It was particularly important to have that option, the ruling declared, because the evidence of McIver’s guilt “was not overwhelming or even strong.” Perhaps McIver chance for freedom is RISING… Indeed, in light of the ruling, the big question is whether the Fulton County DA will retry him for the killing. That boat is DRIFTING…
